Terms of Use
During the Term hereof, National-Leads.com hereby will grant to
the purchaser (Licensee) the right to use leads purchased from
National-Leads.com.
During the Term hereof and subject to the other terms and conditions of this Agreement, National-Leads.com grants to Licensee a non-transferable, non-assignable limited license to use of the Leads.
By accessing or using the Site, the Licensee agrees, without limitation or qualification, to be bound by, and comply with, the terms and conditions set forth below. National-Leads.com may modify this Agreement at any time, and such modifications shall be effective immediately upon posting of the modified agreement on the Site. You agree to review the terms and conditions of the Site periodically to be aware of such modifications. Your continued access or use of the Site shall be deemed your acceptance of the modified Agreement.
Under no circumstances, will the Licensee be entitled to a refund.
National-Leads.com is not responsible for the use of its leads by Licensee or any other end user.

National-Leads.com is not responsible for the use of its leads by Licensee or any other end user.
Obligations of National-Leads.com
Opt-in Leads purchased through National-Leads.com are: Leads that have been acquired from vendors advertising for visitors to receive information about a home business opportunity.
The Leads, to the extent inventory so allows, are to be delivered in the quantity and frequency set forth in the Licensee's order (placed via telephone, website, or email).
Any lead sold as a "Real Time Lead" shall contain a valid telephone number and shall not be duplicative of any Leads previously provided in the previous 30 days to the Licensee by National-Leads.com during the Term of this Agreement. Should any Lead provided not contain a valid telephone number, in the alternative, be duplicative of Leads previously provided in the previous 30 days to the Licensee by National-Leads.com during the Term of this Agreement, then National-Leads.com agrees to give the Licensee a replacement lead of like kind for each such Lead if, and only if, the Licensee identifies the defective Lead in writing and notifies National-Leads.com within 72 hours of fulfillment of the Licensee's order.
National-Leads.com 's obligation to provide credit for Leads is limited to a maximum number of leads that is equal to 10% of the total number of leads that Licensee purchased in this transaction. Upon notification to National-Leads's Customer Service Department by telephone, National-Leads.com may, at its sole discretion, provide credit for defective Leads in excess of the 10% limit. National-Leads.com may terminate this Agreement and/or refuse to fulfill a Licensee's order if National-Leads.com determines that the Licensee is abusing its replacement policy.
All other types of leads, including all Leads sold as Aged Leads, Voice Leads, or Email Leads receive no replacements. In lieu of replacement, National-Leads.com provides 10% extra leads with the Licensee's order to compensate for any invalid Leads.
Under no circumstances, will the Licensee be entitled to a refund.

Obligations of Licensee
Licensee agrees to use the leads in a manner that strictly complies
with all applicable state, federal, and international laws. This
includes, but is not limited to, the CAN-SPAM Act of 2003; the Federal
and State Do Not Call List; and with the provisions of the Federal Trade
Commission's amended Telemarketing Sales Rule, 16 CFR Part 310, or
the Federal Communications Commission's Rules and Regulations
Implementing the Telephone Consumer Protection Act of 1991, 47
CFR Section 64.1200.
In addition, the Licensee shall not use the name of National-Leads, our URL, http://www.National-Leads.com, or any of the National-Leads.com email addresses in the emails and autoresponders that are used for sending out messages. The responsibility lies with the licensee for the marketing materials that are sent out, not National-Leads.com. If the National- Leads.com site is taken down due to any violations of the licensee by putting our name, URL or email address in the body of the email or marketing materials, the Licensee will be held comletely responsible, including any fines, fees, and any fees associated with bringing our site back up. These fees begin at $500 per incident.
Individual Licensees who are purchasing bulk email leads and / or coregistration leads must have a legitimate web site for their business. While this may seem obvious to some, for verification and validation of one's order, the URL of your business web site may be requested. Your information will be kept private, in accordance with our privacy policy, but it may be needed to verify your order.

In addition, the Licensee shall not use the name of National-Leads, our URL, http://www.National-Leads.com, or any of the National-Leads.com email addresses in the emails and autoresponders that are used for sending out messages. National-Leads.com does not guarantee and conversion rates or productivity performance that the leads provided pursuant
to the terms of National-Leads.com and makes no representation whatsoever
regarding the suitability, creditworthiness, viability, or legitimacy
of the Leads. National-Leads.com exercises no control over, and
accepts no responsibility for, the acts and/or omissions of the leads.
National-Leads.com makes no representation regarding whether the use by Licensee of the leads is authorized pursuant to the Federal Trade Commission's and Federal Communications Commission´s Telemarketing Sales Rules (i.e. "Do Not Call Registry"). Except as otherwise expressly set forth in this Agreement, the Licensee hereby agrees that the leads are provided on an "as is, as available" basis.
It is the sole responsibility of the individual Licensee to have their list checked against the national and state Do Not Call registries.
National-Leads.com makes no representation regarding whether the use by Licensee of the leads is authorized pursuant to the Federal Trade Commission's and Federal Communications Commission´s Telemarketing Sales Rules (i.e. "Do Not Call Registry"). Except as otherwise expressly set forth in this Agreement, the Licensee hereby agrees that the leads are provided on an "as is, as available" basis.

Lead Specials
On various occasions, National-Leads.com will have special pricing or a certain percentage
of extra leads added to an order. These specials are for a limited time, according to the
time indicated for the special. After the limited time, regular pricing and quantities will
resume, and special pricing, lead overages, and/or other specials will cease for that special.
Furthermore, any increase in lead overage is not to be considered "free leads," but an overage. An overage is a percentage of extra leads added to an order which can help cover any leads that would be "invalid." In other words, no lead replacements will be given because an overage was already given to help cover any lead that is invalid.

Third Party Orders
National-Leads.com does not allow third party orders. A third party order is when one party, using his or her
credit card, purchases a leads package for another party, the one who is to receive the leads. The purpose for
this terms of service is not to discourage team members working together, rather, it is to eliminate fraud and
other unscrupulous activities.
If you are going to be purchasing leads as a team, simply contact us, and we can help make those arrangements. Otherwise, leads are only sold and distributed to the individual Licensee.

Indemnity
Each party hereto agrees to indemnify, defend and hold the other party
harmless from and against any and all actions, claims, demands,
proceedings, liabilities, damages, judgments, settlements, fines,
penalties, costs, and expenses, including attorneys´ fees and related
costs, which (1) arise solely or in part from the act(s) and/or
omission(s) of the indemnifying party; or (2) arise from or are
related to a breach by the indemnifying party of any express warranty
contained herein.
All rights not expressly granted herein are reserved by National-Leads.com. This Agreement does not grant to the Licensee the right to use the Leads for any other purpose not expressly set forth above. National-Leads.com does not grant any implied license under any patents, trademarks, trade secrets, copyrights or other proprietary rights held by National-Leads.com.
The use by National-Leads.com of an Online Lead Generation Form prepared by the Licensee or any third party does not grant to the License or any third party any rights whatsoever in and/or to the Leads generated therefrom.
The Licensee agrees not to use the Leads in any manner that is deceptive, improper, wrongful, unethical, and/or unlawful.
These policies and terms of agreement are provided for each individual who purchases a list or report from National-Leads.com By proceeding with a purchase, the purchaser (Licensee) agrees to the terms set forth in this Agreement.
